Purchasing a short sale property can be one of the most complicated processes in residential Real Estate.  Buyers need to choose their lender carefully, for a lender who is inexperienced with the short sale process can unintentionally cause a substantial amount of harm to their client.

 

In a short sale transaction, the offer is contingent upon the approval of the investor of the loan.  Many Realtors and loan officers do not understand the difference between a "Servicer" and an "Investor."  The Seller may be receiving a monthly mortgage statement from Bank of America, or Citi Mortgage, however, the owner or benefactor of the loan may actually be Fannie Mae or Freddie Mac.  The key to purchasing a Short Sale property is to use a Realtor and loan officer who fully understand the short sale process and know how to negotiate with the investor, not necessarily the servicer of the loan.  Ultimately, the servicer, in most cases, cannot approve the short sale without investor approval.
